Terms of Service

1. Acceptance of Terms

By accessing or using Hively's services, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services. Hively is operated from Palm Bay, Florida.

2. Subscription Terms

Hively offers subscription-based plans billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are subject to change with 30 days' notice.

3. Cancellation Policy

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access will continue through the end of your current billing period. After that, your AI agents will be deactivated and your account will revert to a free tier (if available).

4. Refund Policy

No refunds are issued for the current billing month. If you cancel mid-cycle, you will retain access for the remainder of the period you have already paid for. We do not offer prorated refunds. In exceptional circumstances, refund requests may be reviewed on a case-by-case basis at our discretion.

5. SMS / Text Messaging

By checking the SMS consent box on our contact form, you opt in to receive SMS text messages from Hively Automation LLC, including account notifications, appointment confirmations, missed-call follow-ups, lead notifications, and service updates. Message and data rates may apply. Message frequency varies. Reply HELP for help and STOP to unsubscribe at any time. Consent to receive SMS is not a condition of purchase. We do not share or sell mobile phone numbers or SMS opt-in data with third parties or affiliates for marketing. See our Privacy Policy for more detail.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful or fraudulent purpose
• Attempt to reverse-engineer, exploit, or disrupt our platform
• Impersonate another person or entity
• Send spam, unsolicited messages, or abusive content through AI agents
• Resell or redistribute the service without written permission
• Use the service in a way that could harm Hively or its users

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

All content, branding, and technology provided by Hively remain the intellectual property of Hively. You retain ownership of any business data you provide to the platform.

8. Limitation of Liability

To the maximum extent permitted by law, Hively and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service.

Hively's total liability shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.

9. Service Availability

We strive for high uptime but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.
